NYS Lemon Law-dealership sold car that was in a major accident without disclosing..

My jurisdiction is: orange county, ny

We purchased a used second vehicle from a reputable Auto dealership in our County (we have a new car lease with them). It has been in the repair shop 7 times since purchase (3 of those for the same problem & to the tune of $3500) & it was set to go back for an eigth...they did not return our call for service, so in an emergency situation we took the car to a different dealership. They assessed the damage & gave us a list of items that needed repair- to our shock a few of the items repaired two weeks before were the same as the last visit to the original dealer!
But the biggest shock was the fact that they claimed the vehicle had been in a MVA the year we bought it (previous owner)! :eek:They told us our car was worth maybe $3000 to them on a trade in! (it is a 2003 bmw325xi & we paid $14,000 for the darned thing a year ago!)
We purchased from our trusted dealership with confidence assuming that THEY would have disclosed that the car had been crashed (we have since gotten a copy of accident report) because we bought the car after their "full mechanical checkup" & incidentally had to pay $550 upon delivery to replace hoses & brake lights with them claiming the car was in tip-top condition! Are we just dumb outta luck because we bought the car with NO warranty at all-& AS IS & without doing the research beforehand?:eek:
Isnt it a moral obligation for a trusted dealership to tell the truth? HA HA!~:mad: ANY help would be appreciated..we plan to pursue legal action to recoup any loss we can since we still owe $11,000 on the loan.
At least now we know why a bmw was giving us such a headache at 70,000 miles!:confused: THANKS AGAIN! dnb
