My jurisdiction is: OREGON

I got laid off on 10/09/08. I worked there for 4 years. I was a Lot Attendent
at a car dealer. The day I got laid off my manager told me I did not have to come back to work anymore and gave me my last pay check and my vacation pay. I asked him why I was getting laid off he replied "they are unable to sell any cars now and it's slow" I didn't understand why they were laying me off because they hired a couple of new employees a few months ago. I believe I was the only one that got laid off.

Today I found an ad for a Lot Attendent on Craigslist, the duties are exactly the same as what I did. Is there anythiing I can do? Is it legal for them to lay me off then post an ad for the same position?

Yes, it is. Nothing in the law requires them to bring you back to work before hring others. This is not "wrongful" in the legal sense.

If you are interested in returning, apply for the job.
