I posted yesterday asking how much time someone on probation would get if they got a new DUI charge. The person is on 4 years probation for pleading guilty to 3 counts of reckless endangerment and a slew of lesser charges. The served less than a year of probation before getting this new charge. This is his third DUI but one of them is over ten years old.
The info is this..... When he was pulled over he actually refused the blood test, so obviously there is no BAC documented. What would the official charge be since he refused? Also, when he pled to the original charges and received the probation he never actually reported to his officer. He was arrested on a previous Probation Violation and got out of jail 6 months ago. So this would actually be his second probation violation.
My questions would be..... Given the history will he probably get the Max amount of time? And since he refused the test will they still violate him since they don't have a BAC?
