We live in Arizona and last year from May '07 until May '08 we rented from a company called Brewer Caldwell. From the time we moved in we had problems with the company, the house was a filthy mess when we moved in (we have pictures of the layers of dirt and dust covering everything) the carpet was riped and torn with stains throughout the house and the A/C worked so poorly we had nearly 500 dollar electric bills that summer, caused health problems. We documented problems on our move in sheet, we have some photos and a few emails. We fought so much with them we finally gave up determined to make it to the end of the lease get back as much of our $2000 deposit as we could and leave. We paid our rent every month in full and on time, and when it came time to move out we did the move out inspection and waited our 14 business days to see how much of our deposit they would return to us.

Well the money didn't come in 14 days in fact we did the walk through on the 2nd of May and didn't recieve the money until June, and the then it was only for $300!! When we asked for a list of repairs they show us a list that has problems on it we documented when we moved into the property, they want to charge us to clean AND replace the carpets?? We filed a claim in small claims court because we can't afford an attorney and they had the case moved to justice courst because they want legal representation and they said in paper work they intend to file a counter claim for nearly $2000! They have yet to file a notice of apperence for any lawyer and they haven't filed a counter claim so we still don't know what that is about. We have a pre-trial hearing on the 14th of August.

Can anyone tell us any specific laws we can use to back our case up, this company is all of the rip off site, can we use any of that information in our case? Any solid legal advice would be greatly appreciated because regardless if they get a lawyer or not we don't have the money to hire one, I'm seven months pregnant and we are trying to get a ready for the baby in the middle of all this.

Thanks.
