My cousin was just served because she wants to move to Texas with her son. His father doesn't pay child support but has court ordered visits. He's protesting the move and per the filing they have to go to Family Court Mediation first.
My question is, does she have to file a repsonse to his declaration?
 
Yes she must respond or she risks losing custody to dad, or losing in default. She can't just ignore it.

Childs upport and visitation really don't have anything to do with each other. Is he ordered to pay support? Can your friend prove the move is in the childs best interest? Dad certainly has the right to dispute the move.
 
If the move is proven to be in child's best interest its very likely the expense for visits will fall on custodial parent because they put the distance between NCP and child
