Breaking and entering during Divorce

Ok, here is the question..Short Version.

Sister is going through a divorce.
Her soon to be Ex breaks into her house, smashes her personal effects and takes items that do not belong to him.

In July of 07 he was court ordered to leave the house.

The Police are telling her nothing can be done because his name is on the deed.

Is this true?
 
What does his name being on the deed have to do with destruction of personal property?

Thats why I am asking the Question.

The police refused to do anything about it, so we now have to rely on her divorce lawyer to hold him in contempt at best.

What state is this?

Very often, this is going to be seen as a civil issue. if he violated a court order to stay away from the property, the court can address this. If he no longer had any legal claim to the property, the police MIGHT be able to take some action, but it would appear that they see this as a civil issue.

She should take this up with her attorney.

I agree with CDW. He may have violated a court order but it is technically still his house. It is not clear if there is an actual RO or if the court just told him to move out, but if the house is in his name, this is probably not a criminal matter.
