My husband was charged a few years ago with a felony DWI. He's done all the treatment programs and is now going through plain old Probation. He has done nothing, but follow the rules by the book since his conviction and we have worked hard as a family to make sure that he is not in any situations that may get him in trouble. He has been very sick with a head cold and has taken some cold medication including Sudafed. He had to do a urine test for his PO on Wed of this week. They said he tested positive for Meth! He's never used meth in his life....we don't even know anyone that uses it. Oh course they cuffed him and took him to jail. Upon booking him in they did another urine test. The cops told him it was clean. But he still sits in jail waiting for a test to come back from the state. If the test from the state which is on the first sample of urine comes back positive they may execute his DWI sentence of a year in jail. I believe the test was contaminated somehow or it's just the cold medication. I can't believe they would be so heartless as to throw a mans life away over legal over the counter cold medication. Is there a way to fight back? I can't have him get locked away for a year. We have a house, a mortgage, bills and a baby girl in daycare. My paycheck barley covers a third of the payments. He is a great husband and the best father I know. He even takes care of our baby two days a week so our daycare costs are lower. The most important thing to me is that I don't want to have our baby miss a year of life with her father or have her standard of living decreased. If he goes away I go bankrupt and will become a burden on the state's welfare system. We will loss everything if they put him away over cold medication. He is completely innocent what can I do?
