Arrest, Search, Seizure, Warrant Workers Compensation and Illegal search and siezure resulting in california pc 11357

OK. An individual gets injured at work and is covered under workers-comp...afterwards they get a dui #2 conviction and is subsequently placed on informal probation for 3 yrs and 18 months alcohol rehab...then this idiot gets busted walking down the street (cause his license is suspended) the police ask a bunch of coercive questions and then find maybe 2 grams of marijuana and hand out a 11357 ticket. Question is:

a. Should the defendant try to go for a pc 1000 or is it too late being he already is on probation for dui.

b. If the defendant does PC 1000 will it affect his Workers Comp.

Should be noted that due to many hardships this year defendant is very despondent due to recent divorce, 3 near death experiences, lost Class A license after DUI, IRS issues, Recent mugging and robbery resulting in the loss of only valuable assets in lieu of 2-3k, collections, child support, Still in pain from work related accident and broken bones and rearranged facial features must be causing the depression...not the marijuana cause it was a factor only recently. But it did violate probation...about $100 dollar fine.

Go ahead and give up the bad news...normally individual would just do the time however getting medical treatment finished is most important and marijuana was recieved because other painkillers were ineffective . However Have been drinking since 13, using marijuana since 13, tobacco...Currently prescribed oxycontin,...should he bother getting clean or is it a waste of time now. In that no job inability to get hired inability to get welfare inability to get to work inability to pay fines, child support, debts, IRS...leaves this person no choice but to turn himself into a criminal because those things must be taken care of especially child support. So should he get incarcerated on purpose? Otherwise he probably won't eat without lie, cheat,steal. Sorry this thing is so long.

Should I just Quit.

Wow .. Shouldn't the worker comp claim resulted in a drug test then should have been denied the worker comp claim and fired because of the companys no drug use policy.. Also a dui.. Sounds like some one is just looking for more trouble.
