I live in Florida. My ex husband and his current wife lied on a continuous marriage affidavit when they sold the marital home my ex and I shared. They both signed the affidavit which stated that they had been married to each other at the time they acquired title to the home and had remained so without interruption until the date of the sale. In fact, my ex husband and I had purchased the home together in 1997. With this document they were able to avoid dividing the proceeds from the sale with the issueance of two separate checks as was ordered in our divorce. My ex kept my share and used it to purchase a new home for himself. I have filed a motion for contempt/enforcement against my ex husband. My question is this: Since both my ex husband and his current wife lied on the affidavit aren't they both guilty of fraud or perjury? If so, what consequences could they face?
