I was issued a payday loan in March 2007. I haven't been able to pay the loan in full. due to health issues and no supplemental insurance.

The payday loan collector called my home in July 21, 2007 called me a liar, deadbeat, thief and said that I better call him back, or he would sue me. Now this was left on my answer machine.

Now two weeks ago another payday loan collector called a reference, she wasnt at home and left a message, that he was trying to get in touch with me, his name was Mr. Walker and that he was from National Payday Loans, and that I owe him $570 and havent attempted to resolve the debt, and would she please let me borrow the money so that I could pay him off.

Now that was third-party disclosure, a violation of my privacy, and that shouldnt have been left on her answering machine. I have the copies of the tape.

What can I do about this?

Standard answer on expired SOL (statute of limitation) and/or validation and/or dispute letters. There are thousands of posts similar to yours on this forum so I have prepared a standard answer.

Validation letters:

SOL (Statutes of limitation are DEFENSES to lawsuits; they do NOT provide a method to stop someone from suing you. This defense means when they sue you, you answer with the defense that it is barred by the SOL.)

Validation letter samples you can get at :
www.creditinfocenter.com
and www.creditboards.com

Make sure you ask for VALIDATION (and do not accept verification).

Disputes: You can write a letter of dispute to the three credit reporting agencies.

Go this website to find instructions and samples for how to dispute: http://www.creditinfocenter.com/creditreports/

Sometimes errors are easy to remove and sometimes they stick like glue. It is inexpensive to try and not difficult.
