Increase In Child Support/Non Custodial Income

My ex wife has an attorney to get child support raised since one of our children has now turned 18. She has stated she makes no money, however, her new husband is self employed at his business they started after they were married. I don't know if it's only in his name. This is the money used to support her. On their website, it also states she is the Secretary/Treasurer of this business. Does she have to include this as her income?

It depends on your state but I would bring a copy of that to court with me. You can certainly ask that an income be inputed for her. However any income generated from her husband should not be included. It sounds like she is capable of working, so you can argue that she should get a full time minimim wage job.
