A lawyer has recommended that my uncle (in Illinois) set up a disclaimer trust with proceeds from my aunt's estate. The lawyer's concern are tax laws which expire in 2010. An accountant has recommended that he NOT set up a disclaimer trust because he feels that, if anything, the laws will be more relaxed in the future. How large would an estate have to be before a disclaimer trust becomes beneficial. My uncle is reluctant to forfeit control of what would amount to half his estate. A discussion of pros and cons would be most helpful.
